Terms of Service
Plain-English ground rules for using the Overhead app and the overhead.app website.

The 30-second summary. Overhead is a free, independent civic-tech tool. Use it honestly and lawfully to document and report aircraft noise to your local government. We provide it as-is, with no warranty. Any email you send through the app is your speech, not ours.
1. Who these terms are between
These Terms of Service ("Terms") form an agreement between you and the maintainers of the Overhead project ("Overhead," "we," "us") and govern your use of the Overhead mobile app and the overhead.app website (together, the "Service"). By installing the app, opening the website, or submitting an email through our signup form, you agree to these Terms. If you don't agree, please don't use the Service.
2. What the Service does
Overhead lets you capture photos, videos, sound levels, and location data of aircraft overflying your neighborhood, organize those records on your phone, and email them to public officials — specifically the Long Beach Airport Noise Office, your council member's office, and the LGB public-affairs inbox that routes items to the Airport Advisory Commission.
We do not operate, run, or moderate any of the inboxes that receive your reports. Those are public government addresses operated by the City of Long Beach.
3. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Overhead on devices you own or control, subject to these Terms and the rules of the relevant app store (Apple's Standard EULA for the iOS App Store, the Google Play Terms of Service for Android). The Overhead source code is open-source and may be separately licensed under its own license; this license relates only to the compiled, distributed app.
4. Eligibility
You must be at least 13 years old to use Overhead, and old enough to form a binding contract in your jurisdiction. If you're a minor, you confirm a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
5. What you agree to do
- Use the Service only for lawful purposes and only to document aircraft noise and related conditions you personally observe.
- Send only honest, accurate reports. Don't fabricate captures or alter timestamps, locations, or sound levels.
- Respect other people's privacy when capturing photos and video. Aim at the sky, not at neighbors. Be aware that California is a two-party consent state for confidential conversations; don't deliberately record private conversations.
- Comply with our Acceptable Use Policy, which governs the content of any email you send through the app.
- Comply with the terms of your own mail provider (Apple, Google, Microsoft, etc.) when sending mail through their service.
6. What you agree not to do
- Don't use the Service to harass, threaten, defame, or doxx anyone — pilots, council staff, neighbors, or anyone else.
- Don't use the app to flood government inboxes with automated, bulk, or repeated identical messages. Each report should reflect a real overflight.
- Don't reverse-engineer the app to remove safety, privacy, or recipient-disclosure features.
- Don't impersonate other people or claim affiliation with the City of Long Beach, LGB Airport, the FAA, or any government body.
- Don't scrape, redistribute, or commercially resell the third-party flight data the app retrieves from public sources.
7. Your reports are your speech
When you tap "Send to council," the resulting email is sent from your own mail account. Legally, those communications are your speech and constituent correspondence with public officials. Overhead is the tool that helped you compose them, but we do not author, approve, or send them on your behalf. We accept no responsibility for the content of the messages you choose to send.
8. Public records
Communications you send to government addresses may become public records under the California Public Records Act and similar laws, and may be reviewed by city staff, city council, the Airport Advisory Commission, the public, and the press. Don't include anything in a report that you'd be unwilling to see disclosed.
9. Third-party services
The app integrates with the following third parties:
- adsb.lol — public ADS-B flight data feed used to match nearby aircraft and enrich reports with aircraft tail numbers, types, and altitudes.
- ADSBDB — public aircraft registry lookup used to resolve the registered owner/operator for a matched tail number when available.
- Your phone's mail app (Apple Mail, Gmail, Outlook, etc.) — used to actually deliver reports.
- Apple Maps / Google Maps — used to render the map tab.
- Supabase — hosts the public observatory's anonymous tally rows (per-install device id, neighborhood, timestamps, ordinance flag, and tail number where known) so the marketing site can publish aggregated counts. See the Privacy Policy for the exact fields and the on-device controls for opting out.
- Expo Updates / Expo Push — Expo is the framework the app is built on; we use its over-the-air update channel to ship bug fixes between App Store releases, and its push-notification infrastructure for the opt-in civic-calendar alerts described in the Privacy Policy.
- Netlify — hosts the marketing site and the email signup form.
We're not responsible for the availability or behavior of those third parties. Their own terms and privacy policies apply.
10. Free service; no warranty
Overhead is provided as-is and as available, free of charge, for civic use. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that:
- The app will be uninterrupted, error-free, or available.
- Decibel readings, location data, ADS-B enrichment, or aircraft identifications will be accurate enough to be used as legal evidence.
- Any government recipient will read, respond to, or act on your report.
11. Limitation of liability
To the fullest extent permitted by applicable law, Overhead and its contributors will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of (or inability to use) the Service. Our total liability for all claims relating to the Service is limited to one hundred U.S. dollars (US $100).
12. Indemnification
You agree to indemnify and hold harmless the Overhead maintainers from any claim, loss, or demand (including attorney's fees) arising out of or related to (a) your use of the Service, (b) any content you create, send, or share through the Service, or (c) your violation of these Terms or any law.
13. Changes to the Service or these Terms
We may update the Service at any time, including by adding, changing, or removing features. We may also update these Terms; if we do, we'll change the "Last updated" date and (for material changes) surface notice in the next app version. Continued use of the Service after a Terms change means you accept the new Terms.
14. Termination
You can stop using the Service at any time by deleting the app and emailing us to be removed from any signup list. We may suspend or terminate your access to the Service if you violate these Terms or the Acceptable Use Policy.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
16. Apple App Store additional terms
These Terms are concluded between you and Overhead only, not with Apple. Apple is not responsible for the app or its content. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (which is $0). To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
